Judgment On Ali Kushayb

Ali Muhammad Ali Abd-Al-Rahman (Ali Kushayb) was convicted at The Hague-based court on Monday of multiple war crimes and crimes against humanity – including murder, rape, torture and forcible transfer. The chamber is convinced that the accused is guilty beyond reasonable doubt of the crimes. Abd-Al-Rahman will face a sentencing hearing at a later date.

HAGUE OCTOBER 6: at 14:00 (local time), Trial Chamber I of the International Criminal Court (“ICC” or “the Court”) will deliver its judgment on conviction or acquittal in the case of The Prosecutor v. Ali Muhammad Ali Abd-Al-Rahman (“Ali Kushayb”). The judgment will be read out in public in ICC Courtroom. The Trial Chamber will convict the accused only if it is satisfied that the charges have been proven beyond reasonable doubt.

Trial Chamber I is composed of Judge Joanna Korner (Presiding), Judge Reine Alapini-Gansou, and Judge Althea Violet Alexis-Windsor. The judges ensure the fairness of the trial and that the rights of both parties and of the victims are respected.

Mr Abd-Al-Rahman is accused of 31 counts of war crimes and crimes against humanity allegedly committed in Darfur, Sudan, between August 2003 and March 2004. The trial in the case opened before Trial Chamber I on 5 April 2022. A total of 74 witnesses gave evidence during the trial (56 were called by the Prosecution, 17 by the Defence and 1 by the participating victims through their legal representatives).

The 27 guilty verdicts for the leader of the government-backed militia known as the Janjaweed were the first ever handed down by ICC judges over atrocities in Sudan’s Darfur region.

“The chamber is convinced that the accused is guilty beyond reasonable doubt of the crimes with which he has been charged,” said Joanna Korner, the presiding judge.

Abd-Al-Rahman will face a sentencing hearing at a later date.
